Voice of Indonesian Seafarers on International Seafarers Day

In this pretentious day of International Seafarer’s day celebration, on behalf of maritime workers from Indonesia convey a very high gratitude to the all states for appreciating seafarer’s existence as key workers.

It is a good moment by crucially stare with regard the 3 pillars of fundamental global rights constitution for mankind as workers, achieved in the universe: ILO Philadelphia Declaration10 May 1944, Universal Declaration of Human Right adopted 1948 and consolidated ILO-IMO Maritime Labor Convention 2006.


Was highlighted clearly in Philadelphia Declaration that reaffirms the fundamental principles on which the ILO is based and, in particular, that:

a. labour is not a commodity

 

b. freedom of expression and of association are essential to sustained progress

 

c. poverty anywhere constitutes a danger to prosperity everywhere

 

d. the war against want requires to be carried on with unrelenting vigour within each nation, and by continuous and concerted international effort in which the representatives of workers and employers, enjoying equal status with those of governments, join with them in free discussion and democratic decision with a view to the promotion of the common welfare.


Therefore, it is a moral obligation of the workers union represent seafarers as independent NGO and professional organization from Indonesia to serve, voice & fight the rights on behalf of seafarers, that the status become : 

1. The work relationship amongst maritime industry stake holders, to treat seafarers in the level of partnership, instead of commodity-ship relationship;
2. Empowering role of workers union to be more pro-active to serve seafarers need;
3. Establish proper & adequate International standard of wage to mitigate seafarers poverty gaps and gain more prosperity;

4. Equal status in democracy based for any decisions to promote seafarer’s common welfare.  


Other moral obligation is to voice & fight the rights on behalf of seafarers, the aspirations of:


1. To get an endorsement from maritime authorized parties, stating that sefarers are categorized as non-migrant workers in line with the ILO covention C-97. This statement will morally motivate Indonesian seafarers their rights in their own country to get more wider abroad work opportunity with less complicated beaurocracy, by no more reason of raising issue that seafarers will not get a rights protection abroad in the international working place. In term of sefarers protection concerns, it will fulfilled satisfactorily by MLC 2006 compliance by states. 

2. To get an endorsement from maritime authorized parties, stating and categorized that sefarers are lex specialis workers, considered  by UN statement as of below:
It denotes the case where the law determines that a certain right or obligation is valid only in regard to a limited subject-matter or a limited set of legal subjects.

Such endorsement from the UN body will automatically impact to the national rules with regard implementation of the rules to the Indonesian seafarers with the maxim lex specialis refers to a normal aspect of the functioning of the law, understood as a legal system. 
While on the IMO webinar on 24/26 June 2020 during pandemic covid-19 breakout, with title of
"Seafarers are Key Workers: Essential to Shipping, Essential to the World"
The IMO Secretary-General Kitack Lim - opening remarks speech mentioned:
I would like to welcome the panellists and everyone who attending online to this webinar organized to commemorate the day of the seafarer and highlight the contribution of seafarers during this pandemic.
Seafarers are at the heart of everything IMO does. And every year we celebrate seafarers with our Day of the Seafarer campaign.

Therefore on behalf of seafarers, in this day in ILO forum we voice to fight for seaferers rights to be called and categorized as lex specialis workers.

3. Proposing to the maritime authorized parties, on behalf of sefarers to accept and announce a national holiday for seafarers and their family on every date of 25th June during international SEAFARER’S DAY celebration. It will a very crucial gift  as a International wisdom reward to all seafarers and their isolated families for their significant sacrifice roles to the world’s supply chain connectivity contribution.


The above voice of seafarers addresses to those in having authorization to make it happen, such as: President of ILO, IMO Secretary General, IMO member states.


Just in case seafarers all over the world at sea stay un-healthy, there will no wealthy economy worldwide. This can happen when there is a condition of dis-respecting protection of sefarer’s rights occurs.
